I am in similar situation. I have received EAD and AP but planning to move on, using H1-B transfer.
If I use H1-B transfer, have I to ask my new employer to do PERM again and then I-140??
Or
Is it just enough to send a AC-21 letter to USCIS that I chnaged to a new job which is similar to the one for which I got PERM & I-140 approval.
Please advise.

Hi,
My name is Rajeev. I�m working as a senior technology consultant (Senior Business Analyst and Senior Quality Assurance) with a top IT consulting and service company.
Background:
My H1-B visa and 1-94 are expiring on July 06th 2009 (almost 4 months from now) and final 6 year H1-B time is ending on May 2011.
I spoke with the HR manager of my company to renew my H1-B visa four times in last couple of months but every time she says that there is of integration going on (Actually, my company was acquired by another company and right now integration is going process is going on). However, I spoke with the immigration department of my company and they told me that since integration process is under way, however this integration process will not effect the renewal of H1-B process, company will deal it in the same way it was dealing before. I explained this thing to my Manager on Tuesday but again, she was not convinced and want to speak with the her immigration contacts and advised me to wait and didn�t gave me a date when she is going to get back to me ( I don�t know what is going on in her mind).
So far, I�ve not applied for Green card, actually, last September, I submitted all the paper work to my Manager (till Dec 2008, I was employed with the consulting division of my company and afterward, I was transferred to the local account). With this transfer, my consulting division manager refused to process and pay for my GC and advised me that I should apply it through local account.
Now local account is saying that it is very unlikely that they�ll sponsor my GC because there is lot of cost cutting going on and GC process takes anywhere from 10 K to 14K. I did told them that company may deduct the GC fees through my pay. But I didn�t hear anything from them so far. Its been almost 2 months now.
Advise and Help:

I just received all the receipts for I-140/I-485/I765/I-131 from TSC.
As some stupid questions:
- I noticed a number above my name: A0xx xxx xxx. Is this an alien number?
- If so please someone explain since I have my PD on 04/24/2001 I never noticed this number (I might be wrong). It is something good or bad or what this number mean?
- Also, just to have an idea, after all are approved (hopefully without unexpected delays) how long until I have that plastic card GC in my hand?
- any small clue will be greatly appreciated.

President Obama recently mentioned plans for holding a White House meeting to discuss proceeding with immigration reform legislation. And now he is keeping that promise by setting June 8th, just three weeks from now, to hold the meeting. No insurance here covers pre-existing conditions. sorry... Others can correct me, but only india network plan covers emergency conditions that arise from pre-existing conditions.. at least better than nothing. Hence, plan accordingly. You can still get expensive plans with a better coverage but still they don't cover any pre-existing conditions. Regarding normal situations, one of my friends had good experience with them for one of the claims.. pls note, i have nothing to do with them and not a PR for them.
if you shop more, you should get a comprehensive plan that covers everything but will be interesting to see how affordable it will be..

I started shooting rodeo last year with my Nikon D70. The lighting at the rodeos I am shooting is very poor. Last year I shot with a Tameron AF Aspherical LD 28-200mm f3.8 to 5.6. I was able to get some good shots but mostly I was disappointed. I shot up to 1600 ISO in manual, with the lowest f stop possible for the zoom used, auto white balance, AF-C, single area & dynamic area AF mode, and experimented with shutter speeds from 1/60 to 1/500. I was very displeased with the results I got. On the 1/60 end I got to much blur and trying to stop the action the results were to dark. So I invested in a Nikon Speedlight SB-600. Occasionally I would get a could shot, but I almost always get red eye or the horse or cattle eyes are solid white from the flash. I even tryed to fill in the shadows with flash on manual at 1/64. I still get the white animal eyes. This year I bought a Nikor 50mm f1.8 lense. The lighting was very poor, but most of the pictures were better than last year. I am still not pleased with the quality though. I shot with and without flash. Without the flash pictures were still to dark even at 1.8 and had to be digitally enhanced. I shot some at 800 and 1600 ISO. The images are just to grainy. Any one got any advise. Here are four examples from about 2200 shots from Fri & Sat.

My perm was denied recently because "The wage listed in the SWA job order is less than the wage offered to the foreign worker", It took DOL almost one and half years to determine this after a business necessity audit. I am going to start a new application now. What are my chances for an appeal by providing corrected supporting documents, can I apply a new application while an appeal is in progress..
Can I have multiple PERM applications from multiple employers at the same time, with different position titles?
Is there anyway of taking advantage of the old priority date application that was denied with a new application.
I almost lost 2 years in priority date because of this denial...
Please suggest...

While the Emilio Gonzalez and Co are still feeling the heat, while Lofgren and Co remember why this happened in the first place, before Numbersusa and Co get their story together even on this issue. The attention span of Congress, the attention span of the press is very very short.

Sorry for the delay in the answer. I have never heard of an import staying with your FLA file after being erased. It sounds like there is an error in Flash. I would recommend contacting our support - support@erain.com.
Here are some tips from my friend Rushvision on keeping file size low:
There are a number of different things you can do to decrease the file size of your exported SWF. Here are the some things for you to try.
Scale your objects down in the Scene Editor
Go to the Layout Page on the Properties Toolbar and decrease the scene size. You are working with vectors, so your images will scale back up very nicely once imported into Flash.
Some objects have settings that allow you to change the number of segments used to create it, such as the torus and the sphere. Decreasing the number of segments will reduce the amount of data that needs to be rendered.
Get rid of any unnecessary bevels. These add considerably to the total number of polygons that make up the objects in your scene.
In the Preview and Export Editor under the General Options, you can set the Detail Level to low.
Setting the slider farther over to Curves will usually result in a slightly smaller file size, but don't expect this one to work miracles.
Experiment with the different Fill Settings. There is no one setting that works best for every situation. Try combining outlines with some of the simpler fill settings to get the greatest amount of detail and the smallest file size. It will often be a compromise on some level.

I'd just like to add that it would help to see some examples of the images that you're having problems with. It's quite hard to tell from a description what could have gone wrong (or even if it's perfectley expectable, just that you expected the camera to do something else. I've done that more than once ;-)
Upping the ISO is an obvious solution, so is using a different flash than the built-in one, and using the flash directed at the ceiling (or some other white-ish surface, such as a piece of cardboard). By bouncing the flash, you get a more spread out light, and the picture will not be so harsh.
You can probably also lighten the images somewhat in Photoshop (or whatever photo editing software you like to use). This obviously doesn't work if the image is completely black and you want white walls, but if it's one or two stops short of right, you should be able to get it 'almost' right.
But seeing some pictures of yours would most likely help a whole lot more than talking about them...

If she plans to continue with her current employer after her travel, there is no harm in using AP. Once she comes back on AP, she automatically resumes her H1B status on the next H1B extension filing within US.
If she is OK with going through the hassles of visa stamping, that is fine too.

What we do know is that the legal immigration system is broken.

Frankly, and just just like in October when I first wrote about this, we do not really know exactly how many cases are pending immigrant visa availability. What we do know is that the legal immigration system is broken.
When we hear politicians and uninformed folks yelling about illegal immigration and telling folks to wait in line like everyone else, the answer is, What Line?
These numbers once again poignantly express the dilemma that legal immigrants have. Many feel, justifiably, that any immigration reform must FIRST focus on legal immigration reform, cutting down wait times to reasonable periods, BEFORE anyone who entered into or remained in the U.S. without permission is given ANY legal benefits. Please take a look at page 249. If I understand it correctly, it mentions that the quota for EB1 goes from 28.6% of EB visas to 15%, EB2 goes from 28.6% to 15% and EB3 goes from 28.6% to 35%
That means they WILL create a new category of EB visas since they have to utilize these extra visas somewhere!
Am I reading it right?
I believe that the visas made by cannibalizing EB1 and EB2 will go to the EB unskilled worker category. It would be terrible if the quota is not increased, if advanced degree+3 year people are still subject to the quota, but if the visas are reallocated.
That means they WILL create a new category of EB visas since they have to utilize these extra visas somewhere!
