Which part of address change trigger RFE
1) Submitting AR11
OR
2) Changing address for pending 485.
Will any one at USCIS does anything/do processing/look into it, if you just submit AR11.

Address change does not trigger an RFE all the time.
I changed my address recently. Had soft LUD on my I-1485 but no RFE.

to me it looks like filing AC-21 is MUST in case one need to go MTR route rather than optional, could expert or Chanduv23 please clarify?

Hi,
I would have some questions concerning my case (didn't really find anything related).
- Up until December I was in the States under a F-1 visa.
- During December my H-1B was approved for my job which starts in February.
- I left the States at the end of December and reentered in February 2010 under the H-1B.
- I will start work in February and applied for a Social Security Number yesterday.
Now I'm not sure how to file taxes for 2009.
Due to the sign-up Bonus which I got for my new job I received a W-2 form which has 2009 written on it. 25% of my Bonus was withheld. Since I was a student in 2009 I'm not sure whether that is too much or the normal amount. Any ideas?
Are there any special forms I have to fill out due to this Bonus? Moreover: Is the Software I use for making my taxes independent of my Visa status? Do I have to indicate somehow that I was an F-1 last year and am now an H-1B. I mean I didn't even have a SSN last year.
I'm really lost here :(. Any help is appreciated.

Hello,
I am starting this thread to infuse some life into the now dormant contributions to IV. I noticed in the past few days that we have been stuck @ 70,725. All of the core IV members are busy talking to the Senators regarding the SJC bills in Washington and generally working hard to push for our cause.
In the meanwhile i feel we as members of this group should again start the push for contributions as we are certain to face an uphill battle in the House.
So please contribute and ask your co-workers, friends, family to also do so now. This is the least we can do... :D

I am on F1 visa. I enrolled in one of the university. I don't attend university in person. I do attend classes online from another state. My question is that I am resident of which state ?? Will I be automatically resident of state where exactly my university is ? I know it is mandatory to attend classes in person on F1. Can you please advise ? How is residency considered ?

I am on h1b visa (approved & stamped) and its expiring this Oct'10 (I-94 also expiring in Oct) and due for an extension but here's my problem.
Company A filed my petition in a wrong way in 2007 by showing the job title as "mechanical engineering position" though i was working as Analyst in IT. So if company A files my extension now how likely are my chances of getting my extension approved? as there was no amendment submitted by A for a change in my job title. The below are my options so would really appreciate if you all can suggest and share your thoughts?
1. Go for a H1B extension from Company A itself and if RFE/Denied, can i then proceed with a H1B transfer from Company B? Confused here in figuring out that if my extension is denied will i loose my status and am i eligible to file a new petition as a transfer from Company B?
2. Or directly go for a H1B transfer from a new Company B, this way will i have lesser risk in getting rejected?

I just received an email from USCIS saying that my I-140 has been denied. I touched base with the attorney & she has not yet received any documentation from USCIS. This has been the 1st change in my status since Aug 07. My case is pending at TSC.
Does anyone know if this is a fairly common occurance for USCIS to deny I-140 without an RFE? Any advise on what to do next?

Hello I am in H4 in usa.
I have applied for change of status to H1b this year, but still now I haven't received the decision form USCIS.
In the mean time, my H4 status along with I-94 is getting experied by the end of this month Oct. I am not able to file H4 extension as this would overlay my probable H1b status.
Now, If I dont get any decision on my H1b and I don't file H4 extention by the end of this month, what would be status after that? Would I become Out Of Status? What should I do under this situation?
You have 2 options
1. Convert your h1 to premium processing and hopefully get it approved before
your current h4 expires
2. apply for h4 extension - and wait for your h1 application to get through
To be really conservative - its best to file for H4 extension anyway irrespective
of whether you convert your h1 to premium
Dont let your h4 expire cause you wont have any valid status - if for some reason your h1 gets denied

You can still get a 1 year extension claiming that your PERM application is still pending. It all depends on the officer that the decision has not been made on PERM application.
The PERM is already denied and you can not get the extension based on the denied PERM.

This means if you filed 485 on July 2nd you should get a reject letter in the next 25 days unless they retrogress on this as well.
Where did you get "25" days from? Also, wouldn't it depend whether you sent it to NSC or TSC?

Thanks for the response. So, technically, there is a window between when I transfer to Company-B and Company-B files my PERM, in which Company-A can withdraw/cancel my I-140. So, what happens to the status in that case? Will the Company-B H1(transferred) still be valid?
