    Hello,This is my first time here.
    I am graduated F-1 students and now working in my OPT period
    OPT valid 4/1/2008-3/31/2009.

    I am gonna send application for H-1b on 4/1/2009.
    If H-1b approved in April or May 2009.

    My Questions are:
    Can i work and stay in US during 4/1/2009-5/31 ?
    ( what is my status,OPT expired on 3/31/2009,H-1B not approved)

    Can i work and stay in US druing 6/1/2009-10/1/2009
    (What is my status?)

    You cannot work beyond the last day of your OPT work authorization.

    You say you are going to apply for an H1. This can only be done by an employer who has already fulfilled a labor conditions application on your behalf.

    Once your OPT finishes you cannot just stay in the US to wait and see what happens. You will need to leave and if your visa application is approved you can get a visa stamp at your local US consulate and enter the US again within two weeks of your first date of employment which cannot be before October 1st 2009.

    Hi,

    I am in the same state as you are. My H4 expires by sept4,2010 and my H1 starts from Oct1,2010. I have filed for H4 extension to avoid out of status.What are you upto now? Can you travel when H4 extension is filed? any reply?

    I filed this week my N400 based on a 5 years rule;

    I am a freelance book writer and a web market engeneer;
    In 2005 I was let go from my job; I filed for unemployment and I traveld to Asia working part time as writer and looking for a new job and find new places to write about in my book;
    the trip lasted 5 months,

    I attached my taxes for the last 5 years to the application:
    will CIS look at the taxes for 2005 and look at the unemployment benefits together with my international travel?

    AM I in trouble when I show up for the interview? I am concerned

    Folks,
    I need to find document or URL which states that "Employer is responsible to pay for H1B extension for its employee" OR it is illegal for employee to pay for H1B extensions.

    Could somebody help me find that document/memo? I am trying to google it as well.

    I need to submit this to my HR urgently (Red tape process :-( ). I will very much appreciate if somebody has the link/doc/memo handy and point me to it.

    Does anyone know if people who've filed for I-485 can claim unemployment insurance?......The client where I was working cancelled my project due to budget cuts :(....I was wondering if I can claim unemployment till I find a new job. Does any one know any non-desi companies hiring in the Michigan, Ohio, Illinois or Midwest in general?.....I am PMI certified Project Manager with J2EE background.     Hi, My mother lives in Haiti, i was not able to file a petition for her before the earthquake happened. Now with all of that going on, i need to know how to file and get her quicker to the us? Any response will be greatly appreciated, thank you

    I don't know the solution to your problem but I was listening to NPR the other day and they were talking about unknown organizations just trying to catch unawares by getting money up to $4K in promise of filing paperwork to get their family from Haiti to the US.

    Hello,

    The original labor approval is lost by Attorney, how ever he has the copy of the approval. He says we can file I-140 with copy. Any one has had this situation ? What is your experience doing this ?

    this is a little bit off topic, but does anyway know what are the requirements for practicing immigration law in the US? What kind of formal training and bar exam passing etc are needed?

    With the extensive practice that USCIS has provided us, atleast in EB matters I think for most of us it will be a cakewalk. Having gone through the process ourselves we also understand how to treat the immigrant (frequent updates, clear answers, be accessible, provide all options and information) and some of us could make very good immi lawyers (once we get our EADs).

    My friends recommending me that too. I should do law instead of doing MBA. Not a bad idea.;)

    My wife came to US in 2008 on H4 visa. Last year (2009) she got her H1-B visa approved. She applied for a SSN on Oct 1st, 2009 but is still waiting on it! When we enquired from the SS office about the delay they said that her first and last names in INS database are mispelled which is why it doesn't match their system, hence the delay. Even though I showed them the H1-B approval notice with the correct name on it they keep insisting that the INS system that they are verifying against shows the mispelled name. I took an Infopass and went to the INS office and got the confirmation that there is no such problem with their system. Both SS office and INS are not giving me anything in writing that I can take to the other party in order to get the issue resolved. It has been almost 5 months and we are still waiting for her SSN.

    Has anyone else faced this issue?

    What should we do to get this fixed? What are our options here?

    My wife was on H4. Her VISA and I94 are expired. I'm still on H1 (valid). Our 485 applications are pending. We have valid EAD cards but not using them. Can I apply for my wife's SSN using the EAD Card + I485 Receipt? Or does she need to have valid I-94 along with the EAD to apply for SSN? Does she need SSN to work on EAD?

    Yes...you can file. Those are completely seperate process.

    Interesting is they say "you may have trouble coming in" but for valid h1 holders it should not be a problem (wasn't for me..i traveled). They didn't say anything about "it will be considered abondonment of AOS or have negative impact on it"

    I work in a private firm (<300 employees) and they have filed for PERM and is under audit. What would happen to my PERM if a bigger firm takes over my smaller company.

    My H1-B 6 yr limit will expire by January 2010. What are the risks to my immigration status if my company is acquired by a bigger firm?

    1. Will I have to re-file for PERM again with the new company?

    OR

    2. Can I continue under the already audited PERM in smaller company's name?
