You must have filed 2 G28s ( 1for you and 1 for spouse) with the 485. With that logic, when you change attorney, separate G28s are needed to be filed for you and spouse.

How important is filing date when it comes to I-485 processing? Does USCIS process I-485s by Filing Date or by Priority Date? If it does so by Filing Date, and assuming that the dates stay current for a long time, does it mean that a person with a later PD can get his/her I-485 processed before a person with an earlier PD if the person with the earlier PD has a later FD?

Hi,
I am writing here for the first time.
My checks got encashed only for EAD/AP.
I filed concurrently I140/485 and PD is 2006.

I added my older H1b case too of Dec 01 (i hadn't added such old case to my portfolio..didn't see need) and that had a LUD of 10/13/07 maybe due to my submitted cases of 140/ead/ap/485. Those had a LUD on 10/16/07 with notice date of 10/12.
seems like some batch work was done on the 2004 cases today.

I think you can safely sponser visitors visa while you are on H1B. What do you mean by working at clients place? is that place listed on your H1B application. Many times Attorney list any other state as required. I remember my attorney doing this. But still, I don't think it should matter, at the same time, I am not an attorney.

Once you give out your EAD for employment your H1 status goes in limbo. I think the way to go back on H1b status is to exit the country and reenter with H1 visa and then work only for the employer who sponsored the H1b (in case something terrible happens to your AOS).
But again this is just my analysis; and I am not a lawyer.

The only problem is that she started working from Jan 2008. From Oct 2007 to Dec 2007 she was not working. So I donot have her W2 and neither the paystubs. I do have the joint tax return that I filed in 2007, but that does not have her income. Is it possible to say that she was on leave during this period for personnel reason?

My labor has been pending from Jan 03. I am having a combined Bachelor's degree which was not mentioned in the Form 750A[mentioned as Bachelors] I came to know that couple of days back after my attorney informed me that she had sent a amendment latter to change my status two months back after waiting for 3 long years to add "combination of Bachelor's degree".
Should I be really worried at this stage and did any body had this problem or did you amend the 750A form from PBEC.

Hi.
Company A was holding my H1 and i was working at client location at client C thorugh a vendor B. Company A was not paying me correctly and was bugging during my payments.
I dint had any writen contract with A saying i would stay this long Nor any Non copetenct Agrement between me and Company A. Company B is a good friend of mine So i swicthed and transfered by H1 to Company X and still working at C through Company B. So he ended my contract with A and started with X I am not sure if Company A and B had any non compitency Aggrement about me.(I dint Sign any papers). Now A is calling and leaving voice mails saying you are still working at C and will take leagal action on me. Company A still Owes me lot of money around 30K how should my mney back.
Please advice how should i proceed. what legal action possibilities are there that Comapny A can take on me and company B ?

I know that an H1B may be extended beyond the 6 year limit as long as the there has been at least a Labor Cert pending for the past 365 days. So basically, as long as you have a LC pending, the H1B is increased in yearly increments until the GC is approved or denied.
However:
1) Once I-140 is approved, do they automatically extend the H1B (the next time it is due for an extension) by three years?

The only impact will be that you will lose your earlier PD (if 140 gets approved).......Also, it could cause you issues with H1 extensions if you are in 6th year of your H1 and are re-starting the GC process....Note that your LC/I-140 must be filed or should be pending for 365 days or your I-140 must be approved in order to get H1 extensions beyond the 6 year term....

There are no guarantees when you are dealing with the USCIS. I was current in April 2005. Approval came in November 2007. Call the USCIS customer service and initiate service request.
